ConstructionPartsNetwork.com is a marketplace operated by NetCom Services, LLC, a Nebraska limited liability company (“NetCom”). We respect the intellectual property rights of others and expect our users ("Users") to do the same. This policy outlines how we handle content ownership, trademarks, copyright claims, and takedown notices, including those under the Digital Millennium Copyright Act (DMCA). ________________________________________________________ Intellectual Property Ownership - Users may upload product listings, photos, descriptions, and other content (“User Content”) to ConstructionPartsNetwork.com. - By posting User Content, User confirms that: - User owns or has lawful rights to use the content. - User's content does not infringe on the intellectual property rights of others. - NetCom does not claim ownership of User's content but retains the right to display, modify, or remove content for the operation of the platform. ________________________________________________________ Prohibited Use of Intellectual Property User may not upload or post: - Logos, trademarks, or brand names that you do not own or are not authorized to use. - Product images or descriptions copied from other websites without permission. - Content that infringes on any third-party copyright, patent, trademark, or trade secret. ________________________________________________________ DMCA Notice & Takedown Procedure If User believes that their copyrighted work has been copied or used in a way that constitutes copyright infringement, please submit a DMCA Notice with the following required information: 1. Your name, company (if applicable), and contact information. 2. A description of the copyrighted work you claim has been infringed. 3. The exact URL(s) or location of the infringing material on ConstructionPartsNetwork.com. 4. A statement that you believe in good faith that the disputed use is not authorized by the copyright owner, agent, or law. 5. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf. 6. Your electronic or physical signature. Please send DMCA notices to: NetCom Services, LLC Attn: DMCA Agent PO Box 23133 Lincoln, NE 68508 Email: support@constructionpartsnetwork.com Upon receiving a complete DMCA notice, NetCom will: - Review the claim, - Temporarily disable or remove the allegedly infringing content, and - Notify the User who posted the content. ________________________________________________________ Counter-Notice Procedure If User believes content was removed in error, User may submit a Counter-Notice that includes: - Your name and contact information. - Identification of the removed material and its location before removal. - A statement, under penalty of perjury, that you have a good faith belief that the material was removed due to mistake or misidentification. - A statement that you consent to jurisdiction of the federal court in your district (or in Nebraska, if outside the U.S.). - Your signature. Upon receipt, we may restore the content unless the original complainant files a legal action within 10 business days. ________________________________________________________ Trademark Infringement Complaints If your registered trademark is being misused on our platform, please email us at support@constructionpartsnetwork.com with: - Your business and trademark details, - The exact infringing content (URL or item title), - Proof of trademark ownership, and - A signed statement explaining the alleged infringement. We will investigate trademark complaints and take appropriate action, including removing listings or suspending offending accounts. We may request additional documentation to verify your trademark rights before acting.
